Based on the doctor’s admission that when his controlled substance prescribing habits fell below the minimal standard of care of similar practitioners under the same or similar circumstances, those acts and/or omissions individually and/or collectively constitute: a departure from, or the failure to conform to, minimal standards of care of similar practitioners under the same or similar circumstances, whether or not actual injury to a patient is established. Agreement effective 6/12/24.
