Board Action Details 03/09/2022 PERMANENT SURRENDER REVOCATION - Permanent surrender and revocation of license to practice allopathic medicine and surgery authorized by doctor. The doctor admits to violating Ohio Revised Code 4731.22(B)(20) to wit: O.A.C. 4731-26-02, sexual misconduct with patients, and O.R.C. 4731.22(B)(6). The doctor stipulates and agrees that he is taking the action in lieu of further formal disciplinary proceedings in Case No. 22-CRF-0017, pursuant to Sections 4731.22(B)(3), and (B)(10), Ohio Revised Code, as set forth in the Notice of Summary Suspension and Opportunity for Hearing issued by the Board on January 19, 2022. Agreement effective 3/9/22. <br/> <br/>01/19/2022 CITATION - Based on allegations with respect to the care and treatment of eight identified patients, when the doctor: digitally penetrated, vaginally and/or anally, some female patients, for sexual gratification and/or sexual purpose; had sexual contact with patients by touching their breasts in a sexual manner; during medical appointments the doctor rubbed his erect penis against the body of the patients; engaged in a romantic sexual relationship with a patient and then wrote prescriptions to that patient with instructions for her to give patients to office staff; and engaged in sexually explicit conversation using a messaging app, those acts and/or omissions individually and/or collectively constitute: commission of an act that constitutes a felony in this state, regardless of the jurisdiction in which the act was committed, to wit: Sexual Battery; violating or attempting to violate, directly or indirectly, or assisting in or abetting the violation of, or conspiring to violate, any provisions of this chapter or any rule promulgated by the board, to wit: prohibitions regarding sexual misconduct, which also constitutes a departure from, or the failure to conform to, minimal standards of care of similar practitioners under the same or similar circumstances, whether or not actual injury to a patient is established; and the selling, giving away, personally furnishing, prescribing, or administering drugs for other than legal and legitimate therapeutic purposes or a plea of guilty to, a judicial finding of guilt of, or a judicial finding of eligibility for intervention in lieu of conviction of, a violation of any federal or state law regulating the possession, distribution, or use of any drug.
