Based on the finding when the doctor stole glasses of another doctor, inappropriately prescribed scheduled II stimulates to patients for the purpose of weight loss, failed to document testing to diagnose the condition, failed to access or document accessing OARRS at the times or intervals required by the Board’s rules, and failed to appear for a scheduled deposition, and produce records in response to a Board issued subpoena, those acts and or omissions, individually and or collectively constitute: the commission of an act that constitutes a felony in this state, regardless of the jurisdiction in which the act was committed, to wit: Theft; and also constitute violating or attempting to violate, directly or indirectly, or assisting in or abetting the violation of, or conspiring to violate, any provisions or any rule promulgated by the Board, to wit: Utilization of anabolic steroids, schedule II controlled substance cocaine hydrochloride, schedule II controlled substance stimulants, and prescribing for subacute and chronic pain, which also constitute failure to maintain minimal standards applicable to the selection or administration of drugs; and selling, giving away, personally furnishing, prescribing, or administering drugs for other than legal and legitimate therapeutic purposes, and with respect to patients 3, 4, 8 and 10, the Standards and procedures for review of “Ohio Automated Rx Reporting System;” and also constitute a departure from, or the failure to conform to, minimal standards of care of similar practitioners under the same or similar circumstances, whether or not actual injury to a patient is established; and also constitute making a false, fraudulent, deceptive, or misleading statement in the solicitation of or advertising for patients, in relation to the practice of medicine and surgery, osteopathic medicine and surgery, podiatric medicine and surgery, or a limited branch of medicine, or in securing or attempting to secure any license or certificate to practice issued by the Board; and also constitute a failure to cooperate in an investigation conducted by the board, including failure to comply with a subpoena or order issued by the board or failure to answer truthfully a question presented by the board in an investigative interview, an investigative office conference, at a deposition, or in written interrogatories. <br/> <br/>01/11/2024 - CITATION - Based on allegations with respect to the care and treatment of nine identified patients for weight loss, obesity, and/or conditions related to body mass index, when the doctor prescribed schedule II stimulates that were not approved for weight loss, failed to document testing to diagnose conditions, and failed to access or document accessing the Ohio Automated RX Reporting System (OARRS), those acts and/or omissions, individually and/or collectively constitute: violating or attempting to violate, directly or indirectly, or assisting in or abetting the violation of, or conspiring to violate, any provisions or any rule promulgated by the Board, to wit: Utilization of anabolic steroids, schedule II controlled substance cocaine hydrochloride, and schedule II controlled substance stimulants; Prescribing for subacute and chronic pain; and standards and procedures for review of “Ohio Automated Rx Reporting System” (OARRS), which also constitute a departure from, or the failure to conform to, minimal standards of care of similar practitioners under the same or similar circumstances, whether or not actual injury to a patient is established; and failure to maintain minimal standards applicable to the selection or administration of drugs, or failure to employ acceptable scientific methods in the selection of drugs or other modalities for treatment of disease; and making a false, fraudulent, deceptive, or misleading statement in the solicitation of or advertising for patients; in relation to the practice of medicine and surgery, osteopathic medicine and surgery, podiatric medicine and surgery, or a limited branch of medicine; or in securing or attempting to secure any license or certificate to practice issued by the Board. Notice of Opportunity for Hearing effective 1/11/24. <br/> <br/>11/08/2023 - CITATION -Based on allegations that when the doctor failed to appear for a scheduled deposition, and failed to produce records in response to a Board issued subpoena, those acts and/or omissions, individually and/or collectively constitute: failure to cooperate in an investigation conducted by the board, including failure to comply with a subpoena or order issued by the board or failure to answer truthfully a question presented by the board in an investigative interview, an investigative office conference, at a deposition, or in written interrogatories, except that failure to cooperate with an investigation shall not constitute grounds for discipline under this section if a court of competent jurisdiction has issued an order that either quashes a subpoena or permits the individual to withhold the testimony or evidence in issue. Notice of Opportunity for Hearing effective 11/14/23. <br/> <br/> 09/14/2023 - CITATION - Based on allegations that while working at a hospital, the doctor stole glasses of another doctor, and based on the care and treatment of one specified patient, the doctor inappropriately prescribed a scheduled II drug to a patient for the purpose of weight loss, and failed to check or document checking the Ohio Automated Rx Reporting System prior to prescribing, those acts and/or omissions individually and/or collectively constitute: Commission of an act that constitutes a felony in this state, regardless of the jurisdiction in which the act was committed, to wit: Theft; and violating or attempting to violate, directly or indirectly, or assisting in or abetting the violation of, or conspiring to violate, any provisions of this chapter or any rule promulgated by the board, to wit: Utilization of anabolic steroids, schedule II controlled substance cocaine hydrochloride, and schedule II controlled substance stimulants, and Standards and procedures for review of “Ohio Automated RX Reporting System;” which also constitutes a departure from, or the failure to conform to, minimal standards of care of similar practitioners under the same or similar circumstances, whether or not actual injury to a patient is established, and a failure to maintain minimal standards applicable to the selection or administration of drugs, or failure to employ acceptable scientific methods in the selection of drugs or other modalities for treatment of disease.
